The ESPN Total Access Sweepstakes Official Rules.
No Purchase Necessary. Completion of Credit Card Application, or Approved Credit from issuing financial institution (Visa Card Acceptance) is not Necessary to Enter or Win.
All entries, whether submitted by using or applying for an ESPN Total Access Visa® Card as described below or by online entry, or mail-in entry, have an equal chance of winning.
Eligibility: The ESPN Total Access Million Points Sweepstakes ("Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of 10/1/08. Employees, officers, directors, agents and representatives of ESPN/Starwave Partners d/b/a ESPN Internet Venture ("Sponsor"), Visa U.S.A. Inc., Visa Canada Association, their respective Member financial institutions (including but not limited to Washington Mutual, Inc. and all its affiliates (collectively "WaMu"), and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion/fulfillment agencies, anyone else connected with the production and distribution of this Sweepstakes (hereafter, collectively "Released Parties") and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in their same household, whether or not related, are not eligible to enter or win. In addition, the following individuals are not eligible to enter or win: 1) Any current or former professional golfer. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
Four Ways To Participate between 12:00:01AM Eastern Time ("ET") on 10/1/08 and 11:59:59PM ET on 4/30/09 ("Promotion Period"):
1.) Credit Card Application: Receive one (1) Sweepstakes entry when you apply for an ESPN Total Access Visa credit card issued by WaMu (the "Card") online at www.totalaccessmillions.com. Approved credit and/or Visa Card Acceptance not required for Sweepstakes entry. Limit one (1) application entry per person and per email address. Submission of additional/numerous Credit Card Applications will not increase your chance of winning but may have a negative effect on your credit rating. Entry will be awarded to the individual named on the applicable application (regardless of whether that is the name of the authorized account holder of the email address from which said application was submitted);
2.) Purchase: Automatically receive one (1) Sweepstakes entry for each purchase made during the Promotion Period with the Card. Account adjustment transactions/returns, PIN-based and international transactions, late payment fees, over-limit or over-draft fees, return check fees, check re-order fees, cash advances, annual fees, balance transfers and/or other fees assessed on your account are not considered eligible transactions for automatic Sweepstakes entry. Entries from unauthorized card use or made with lost, stolen, or fraudulent Visa cards are void. Only purchases made with the Card in the U.S. to an identifiable end user and that are processed and submitted through Visa International U.S. transaction processing system during the Promotion Period are eligible for automatic entry;
3.) Online: Visit www.totalaccessmillions.com and fully complete and submit the online entry form in accordance with the instructions provided to receive one (1) Sweepstakes entry. Limit one (1) entry per person or valid email address per day; OR
4.) Mail: To enter the Sweepstakes without purchase or credit card application submission, hand print your name, complete mailing address, telephone number (with area code), date of birth, and the words "ESPN Total Access Million Points Sweepstakes" on a plain 3" x 5" piece of paper & mail it in a sealed, stamped and hand printed #10 envelope to: ESPN Total Access Million Points Sweepstakes, P.O. Box 17013, Bridgeport, CT 06673-7013. Enter as often as you wish by mail, but each entry must be mailed separately and post marked on or before 5/1/09 to be received by 5/8/09. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries permitted. Your use of your ESPN Total Access Visa® credit card to make a purchase and/or your submission of a credit card application and/or online entry and/or 3" x 5" mail-in entry constitutes your consent to participate in this Sweepstakes and your consent for Released Parties to obtain, use, and transfer your name, address and other information for the purpose of administering this Sweepstakes. Released Parties are not responsible for lost, incomplete, illegible, late, misdirected, stolen, postage-due, or mutilated entries, applications, mail, incomplete or inaccurate applications; failure to process applications; any error, omission, interruption, defect or delay in transmission, 3rd party transaction classification, transaction processing, or communication; technical or mechanical malfunctions; interrupted or unavailable network, server or other connections; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from participation in this Sweepstakes; printing or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic, cellular telephone related or otherwise. The use of automated entry or similar devices is prohibited and entries through such prohibited devices are void. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Sweepstakes.
Prizes: (1) Grand Prize: 1,000,000 ESPN Total Access Rewards Program Points ("Reward Points") which can be redeemed through the ESPN Total Access Rewards Program Website ("Rewards Website") toward a variety of products/items, including but not limited to, travel, sports merchandise, and/or collectibles. Terms, conditions & restrictions on Reward Points may apply. The winner also receives a trip for he/she and one (1) guest to Los Angeles, CA between 7/13/09 and 7/16/09. Trip includes round-trip coach air transportation for two (2) from major U.S. gateway airport nearest winner's primary residence in the U.S., 3-night standard double occupancy hotel accommodations (one (1) room), ground transfers to/from the airport/hotel/events. While in Los Angeles, the winner and his/her guest will receive: admission to the ESPY Awards at the Nokia Theater LA Live in Los Angeles, CA on 7/15/09, the opportunity to walk down the red carpet while at the ESPY Awards, two (2) tickets to the Red Carpet VIP pre-ESPY party overlooking the red carpet & the ESPY after-party and the opportunity to participate in a 50-foot golf putt (as described below) for the chance to win $250,000. Actual value of trip may vary depending on winner's city of departure and final itinerary. Travel, hotel and other arrangements to be determined by Sponsor. Costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded as part of prize, including, but not limited to, federal, state and local taxes, if any, and food, beverages, airline luggage charges and travel expenses for winner are winner's sole responsibility. Potential Grand Prize winner and his/her guest must travel together on the same itinerary and are responsible for obtaining any/all necessary documents (including but not limited to valid photo I.D.) prior to departure. Other travel/accommodation restrictions may apply. Trip must be taken on dates designated by Sponsor or prize will be forfeited in its entirety. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of Los Angeles, CA, as determined by Sponsor in its sole discretion, and to award no additional compensation in such event. Sponsor is not responsible for travel delays. Sponsor reserves the right to remove or to deny entry to winner and/or guest if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any of the 2009 ESPY Events. Approximate Retail Value ("ARV") of trip: $15,000. (5) First Prizes: 100,000 Reward Points which can be redeemed through the Rewards Website toward a variety of products/items, including but not limited to, travel, sports merchandise, and/or collectibles. Terms, conditions & restrictions on Reward Points may apply. ARV: $1,000. (10) Second Prizes: $250 ESPN Shop Gift Card. Terms, conditions & restrictions on gift card may apply. Reward Points will be deposited in a new and temporary Reward Point redemption account even if they are an existing Total Access Rewards member. This new and temporary reward point redemption account may not be combined with their existing Total Access Rewards account and will have a separate fan ID, userID and password. Reward Points expire 1 (one) year from the date of issuance. Any Reward Points remaining unused as of the expiration date will be forfeited even if winner(s) is an existing ESPN Total Access Visa® cardholder. Redemption of Reward Points is subject to ESPN Total Access Reward Points Terms & Conditions, available online at http://www.espntotalaccess.com/lssFWeb/appmanager/cmw/espnta?_nfpb=true&_pageLabel=Terms. All ESPN Total Access Rewards Point Terms & Conditions apply. In the event that ESPN terminates the Total Access Rewards Point Program, winners will have 1 (one) year from said termination date to use/redeem their Reward Points. Winners' selection of reward(s) is final. There are no exchanges or refunds once any reward is selected. If a reward selected with Reward Points becomes unavailable, ESPN will make reasonable efforts to replace with a similar reward. Rewards are not guaranteed. Some items may be discontinued or no longer offered. ESPN reserves the right to change or cancel reward item availability without prior notice. Federal, state, and local taxes and all other expenses not specified herein are winners' sole responsibility. Total maximum ARV of all prizes (including the 50-foot golf putt for the chance to win $250,000): $272,500.
Grand Prize Golf Putt Details: The Grand Prize winner (the "Participant") will have the opportunity to participate in a 50-foot golf putt (hereafter, the "Putt") to be held at the 2009 ESPY Celebrity Golf Tournament on 7/14/09 at a regulation golf course to be determined by Sponsor. The location of the regulation golf course where the Putt will take place will be determined at Sponsor's sole discretion. The Putt is to take place on the green of a regulation hole at a regulation golf course. Participant must putt from a distance of at least 50 feet. In the event that the golf ball successfully goes completely through the target hole, as determined by Sponsor in its sole discretion, said Participant will receive $250,000 awarded as a check in the amount of $250,000. The eligibility of the Putt is subject to the USGA and/or PGA specifications. The golf ball and golf club will comply with USGA and/or PGA regulations and the Sponsor shall provide them. Any contact with the golf ball by the Participant's golf club after it is placed for the 50-foot golf putt for the $250,000 shall be considered an attempt. The golf ball must be behind the demarcation line prior to the Participant's putting the ball. No part of the Participant's body or clothing may come in contact with the demarcation lines/spots prior to putting the ball. Any such violation shall constitute a foul and the Putt shall be considered a miss. Practice attempts shall be permitted on the green where the putt will take place anytime prior to the Putt, provided such practice occurs prior to the Participant knowing the exact putting location. The Putt will be videotaped for insurance, promotional and other purposes selected by Sponsor. All other details regarding the mechanics and placement of the golf ball and other rules, procedures and conditions for participation in the Putt will be determined by Sponsor (in its sole discretion) and provided immediately prior to the start of the Putt. The Participant may not designate any another person to take his or her place in the Putt event, for any reason whatsoever. Any disputes will be resolved by the independent judging organization on-site at the Putt, whose decision shall be final, conclusive and binding.
Winner Selection: The potential winners will be selected in a random drawing on or about 5/12/09 from among all eligible entries received by an independent judging organization designated by Sponsor whose decisions will be final and binding in all matters relating to this Sweepstakes. Winners will be notified by telephone, email, overnight delivery and/or mail. Prize will be awarded to the primary account holder associated with the ESPN Total Access Visa credit card, email address or person named on an application used to transact a winning entry. Odds of winning will depend on the number of eligible entries received. Limit one (1) prize per person, immediate family member, or household.
Miscellaneous: No transfer, assignment, cash redemption or substitution of prize (or portion of prize) is permitted except by Sponsor due to prize unavailability and then for a prize (or applicable portion of prize) of equal or greater value as determined by Sponsor. Potential Grand & First Prize winners will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within seven (7) days of issuance of notification. Potential Grand Prize traveling companion must be eighteen (18) years of age or older as of 5/12/09 and will be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner. Designation of winners is subject to verification of the Affidavit/Release. By participating, entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification, and 2.) Released Parties and their designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize (including any travel or activity related thereto) or participation in this promotion (including attendance at the designated ESPY events specified above and participation in the golf putt) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Sweepstakes (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, select winners from among all eligible, non-suspect entries received as of the date of the event requiring such termination or suspension.
BY AGREEING TO TAKE PART IN THIS PROMOTION, GRAND PRIZE WINNER ACCEPTS THE RISK ASSOCIATED WITH THIS PHYSICAL ACTIVITY, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE PROMOTION IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT RELEASED PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH.
Sponsor reserves the right to conduct a background check of any and all records of the Grand Prize winner, including without limitation, civil and criminal court records and police reports. To the extent necessary under law, Grand Prize winner shall authorize this background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Grand Prize winner in his/her interview. In that regard, Grand Prize winner will be obligated to provide necessary contacts and information so that Sponsor may conduct such investigation. Sponsor reserves the right (at its sole discretion) to disqualify Grand Prize winner from any prize element, based on the background check.
Email Change Of Address Policy: It is the sole responsibility of the entrant to notify Sponsor if his or her email address changes. To do so, click on the help link at the bottom of any ESPN.com page, then click on the Change Personal Information link and follow the instructions.
Disputes/Choice Of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these official rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York State, i.e., Manhattan, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Sweepstakes will be used to administer the Sweepstakes, select prize winners and fulfill prizes, and will be treated in accordance with Sponsor's privacy policy accessible on its website at www.espn.com.
